October 4, 1992 Nineteen years later a Notice of lis pendens was filed record # 171171
NOTE; Weber Height nonprofit Association was not named on Page 1, Page 2 or Page 3. of the action.

October 22, 1982 Wilson and Lorie Cantrell and Elater and Chalortt Wood become land owners after the Oct 4, 1992 lis pendens was filed.

March 13, 1985 an Attorney?s notice letter was delivered to property owners and Weber Valley is not named in that letter.

March 15, 1985 Charles Reed Jr. signed a Grant of easement record # 53702 and Weber Valley is not listed as a rights owner. Charles Reed Jr. then sold his property.

November 3, 1989 CA Water Code Section 13801 applies to all new wells.

Febuary 26, 1990 an application for a welll drillers permit was submitted to Riverside County Envrionmental Health for APN #571-030-037. AKA Deborah St Pierre's property.

Febuary 27, 1990 a well drillers permit was issued for Deborah St Pierre's property APN# 571-030-037.
 
 

April 13, 1990 Charles Campbell signed a grant of easement  APN# 571-040-002
May 24, 1990 the Grant of Easement by Charles Campbell was recorded #191167.
May  1990  Lynch Wells drilled a new "domestic use" well as shown on the well drillers report. The well location is on  APN # 571-040-002 (AKA the Campbell's)

How and when did the non profit property rights tranfer to the mutual benefit association?

July 13, 2002 The Association revised Bylaw name and status as a non-profit changed.

CA Corp Code. section 18000 now applies as in mutual benefit association.
Title 22 Chapter 14 §64211. Permit Requirement.  (c) A change in ownership of a state small water system shall require the submission of a new application.
§64215. Water Supply Requirements.
§64216. Mutual Associations Prohibited.
No state small water system which was not in existence on November 12, 1991 shall be issued a permit to operate.
September 11, 2004 Weber Valley Heights Water Association, no longer a non-profit held a meeting agenda pg 1-2 and  elections of officers.

Deborah St Pierre was last elected President oe WVHWA and she failed the association on September 11, 2006 by not calling for an election of a new board as required by the bylaws.

As of Sept. 12 2006 an incumbent board representing Weber Valley Heights Water Association no longer existed according to CA Corp Code section 18410 (c) and therefore Weber Valley Heights Water Association failed to exist as a CA mutual benefit association.

Deborah's charade started on September 12, 2006. Assetts of the disolved association (finical accounts) continued to be controled by the past president. She in her own mind seemed to think she remained the association President even after failing to uphold the required association bylaw for election. Her actions lasted from September 12, 2006 until January 14 2012.

All legal documents representing the association signed after September 11, 2006 that were signed by Deborah St Pierre as President of WVHWA were signed by fraud, her elected  term as President of the Association had expired. Her new title was past President.
Deborah St Pierre falsifies documents to the Department of Environmental Health by claiming to be President of WVHWA after September 11, 2006. What she did was fraudilent.
After the date of September 11, 2006 Deborah St Pierre using the USPS mailed letters claiming she was the President of the association that too was f.raud.

July 2010 to fullfil her own twisted plan Deborah St Pierre spent unauthorized funds for advice from Attorney Alex Hershey.
July 7, 2010 Deborah St Pierre then related her findings from the Attorney Alex Hershey.
July 15, 2010 Deborah sent a letter to Beverly Heath.
July 19,2010 Deborak wrote what her motive was, "It is about this member making money off our water".
July 23, 2010 Total services conections are admitted.

Deborah St Pierre sent out ballots that failed to conform to CA Corp Law and  not authorized at a meeting or by ballot by the well owners.

Deborah St Pierre using the USPS sent a letted demanding a property owner follow her demand or the legal and appurtenant granted recorded right would be denied.
August 10, 2010 Deborah St Pierre claimed "We won't be in the state small water system next year".
August 12, 2010 Deborah St Pierre wrote "This member is making a lot of money off our water".
August 12, 2010 Deborah St Pierre delivered by mail a ballot without a time for return asking should members uphold bylaws.
Hess voted and Deborah St Pierre shared the tabulated illegal ballot results. Hess is not listed as a well rights owner.
August 23, 2010 Deborah sent a "Notice of intention to terminate water service".

September 27 2010 Deborah St Pierre sent an illegal ballot trying to terminate Reed's water service.
October 14, 2010 Deborah St Pierre provied false information to a Riverside County Sheriff.
November 30, 2010 Without easement owners approval  Deborah St Pierre spent unauthorized funds at attorney Best Best and Kreger.
November 2, 2010 Deborah St Pierre planed to expand the rights granted within the 1990 Grant of easement.
December 3, 2010  Deborah St Pierre spent more well owners money for Deborah's personal research goals..
January 2, 2011 Deborah St Pierre provideds proof she believed the ballot was to completely terminat Heath's water, it stated uphold bylaws.
January 11, 2011  Deborah St Pierre continued her spending spree without consideration of her actions.

January 3, 2012  Deborah St Pierre still claiming to be President of the failed association called for a group of people to attend a garage meeting held at Dan Spears property.

  • On January 14, 2012 that group consisting of both renters and real property owners voted on a new board of directors. They failed to name their new association.

  • The group consisted of,

  • Property owner Dan Spears,  book/map 53/53 parcel -1
  • Property owner Debbie St. Pierre, Bob Franko book/map 53/47 parcel -2 and 3
  • Property owner Sherry  Reed parcel 53/40 parcel book/map 53/40 parcel -2
  • Property owner Leroy and Janice Smith book/map 53/51 parcel -1
  • Property owner Gary Boer book/map 53/43 parcel -2
  • Property owner Jeff Hall book/map 53/53 parcel -4
Property renter Eric Schaumberger he seconded votes and was a non easement association right owner.
Property renter Tina Ziegler was also a non easement right owner.
  • The Minutes from last meeting held on September 11, 2004 were dispersed and discussed.
  • No bylaws were adapted for the new mutual benifit association consistiong of both real property rights owners and the property renter who moved motions as noted by Tina Ziegler who somehow was appointed as a temporary Secretary.
  • At the close of the meeting on January 14, 2012 that adjourned at 2:10pm a new mutual benifit association group was formed without bylaws and without a name.
  • The previous association either the non-profit or the mutual benefit association no longer existed according the law of the land that being

  • CA Corp Code TITLE 3.  UNINCORPORATED ASSOCIATIONS Article 6.
    Dissolution ..18410-1842
    18410.  An unincorporated association may be dissolved by any of the following methods:
       (a) If the association's governing documents provide a method for dissolution, by that method.
       (b) If the association's governing documents do not provide a method for dissolution, by the affirmative vote of a majority of the voting power of the association.
       (c) If the association's operations have been discontinued for at least three years, by the board
            or,  if the association has no incumbent board.
       (d) If the association's operations have been discontinued, by court order.
     

    18420.  Promptly after commencement of dissolution of an unincorporated association, the board or, if none, the members shall promptly
    wind up the affairs of the association, pay or provide for its known debts or liabilities, collect any amounts due to it, take any other action
    as is necessary or appropriate for winding up, settling, and liquidating its affairs, and dispose of its assets as provided in Section 18130.
     
     

    section 18410 (c) .

18100.  The interest of a member in an unincorporated association is
personal property.

18105.  An unincorporated association may, in its name, acquire,
hold, manage, encumber, or transfer an interest in real or personal
property.

18110.  Property acquired by or for an unincorporated association is
property of the unincorporated association and not of the members
individually.

18115.  The acquisition, transfer, or encumbrance of an interest in
real property by an unincorporated association shall be executed by
its president and secretary or other comparable officers, or by a
person specifically designated by a resolution adopted by the
association, or by a committee or other body or person authorized to
act by the governing principles of the association.

5223.  (a) The superior court of the proper county may, at the suit
of a director, or twice the authorized number (Section 5036) of
members or 20 members, whichever is less, remove from office any
director in case of fraudulent or dishonest acts or gross abuse of
authority or discretion with reference to the corporation or breach
of any duty arising under Article 3 (commencing with Section 5230) of
this chapter, and may bar from reelection any director so removed
for a period prescribed by the court. The corporation shall be made a
party to such action.
   (b) The Attorney General may bring an action under subdivision
(a), may intervene in such an action brought by any other party and
shall be given notice of any such action brought by any other party.

Weber Valley Heights Water Association
Minutes
September 11, 2004

The meeting was called to order by President, Jack Dickey. Many new property owners/members were attending their first association meeting. All present introduced themselves. Those present were Jack and Della Dickey, Gary and Pat Boer, Lee and Janice Smith, Debbie St. Pierre, Veronica Moore, Martha and Javier Morales, Jeff, Maria, Jett and Tia Hall, Alan and Daniel Lamb, Beverly Heath, <EIoyAranda (guest of B. Heath) , and Chris Knapp (renter of B. Heath).

Beverly Heath has purchased the property previously owned by Paul Klausing, Martha and Javier Morales have purchased the Blackwelder property, the Hall family purchased the property previously owned by Grace Wickham
and Alan and Danielle Lamb now own the property previously owned by Gil and Norma Gaston.

The minutes of the July 13, 2002, meeting were read. Lee moved and Debbie seconded the minutes be approved as read Unanimously approved.

The treasurer's report was given by Veronica Moore showing a balance of $3,404.63 as of 9/11/04. Debbie moved and Lee seconded the treasurer's report be accepted as read Unanimously approved.

Correspondence was noted from Earl Blackwelder informing the association they had sold their property to Ms. Morales. He stated that his dues were paid in full and thanked everyone for being good neighbors. Correspondence has been filed.

Maintenance Report:
         1. A 2" line was completed from the tank to Bob Franko's meter. This was done to help the pressure
              problems that were occurring. Debbie noted it worked well and has solved the problem.
          2. A2" supply line leak was repaired on the Leuschen property (now owned by Wendy Andersen).
          3. The water tank automation problem has been repaired.
          4. A 1" supply line has been repaired.
          5. It was noted that the leveling gauges and the shed have not been completed at this time.
G. Boer, Lee S. moved and seconded the maintenance report be accepted Unanimously approved

Old Business
Jack informed everyone the water line needs to be worked on again. The surface of the road erodes and the water line comes to the surface. Debbie noted that all is okay at the moment, however, when the rains occur, it would be beneficial to work on the line.

Gary will put a water level sight gauge on the tank.

Debbie stated that the control line from the well house to Gordon's is encased in conduit above ground. This part of the automation is in good shape. The rest of the line from Gordon's to the tank needs to be encased in conduit

It was noted that the ladder on the tank needs to be repaired. Lee donated a ladder. Vicky noted that they may also have a ladder tall enough for the tank.

New Business
Moore's phone line will be replaced by the phone company soon. Vicky noted it would be a good time to run a line in the trench at the same time providing the phone company would allow other lines in their trench. There is pipe under Jack's trailer if this can be accomplished.

New Tank: A new tank is needed. There was discussion of plastic vs. metal tanks. There was also questions as to
warranties that may come with or be purchased additionally with the tank An estimate for a plastic tank from Big,
Pete's was $2000 for a 5000 gallon tank. Vicky volunteered to get pricing information and report back to Debbie
Pat. Vicky asked if the members would install the tank if she had it delivered to the site? Gary said he would be
glad to install the tank and would appreciate any assistance from others. Gary moved Beverly seconded we
explore costs for a 5000 gallon metal tank with delivery only and approval for a "Vote by Mail" when info is received .
Vicky announced that Weber Valley Heights Water Association now has a new address. Bob and Debbie donated a
mailbox which will be located at the comer of R3 and East Benton (the old site of the fire department). The address
is 44350 Benton, Hemet, CA 92544.

Debbie asked that the agenda item requesting membership in the water association for the new property they
purchased be tabled at this time.

Janice Smith requested information on the meter she needs to acquire for the property they purchased from Mark Leuschen. The meter should rate at cubic feet, not gallons. (FYI: It was noted there are 7.5 gallons per cubic feet
and we charge 2 cents a cubic foot.)

State Small Water Association Yearly Assessment: The assessment fees for two wells is $795 per year. There is
also quarterly water testing @ $30 per well plus nitrate testing at $83.33. These fees have been raised in past and
can be raised again in future.
Sample collections for testing can only be done by a person certified by the State Small Water Association. Bob
Franko was certified many years ago. We were informed that testing shows no iron and low bacteria levels in the
water. The testing fees are a responsibility of water users and non-water users alike therefore an assessment is
called for to fairly divide the billing between all members of the association. (The water usage fees go into the
treasury for maintenance needs). Vicky moved and Debbie seconded there be a $100 assessment per year per
member for the state water assessment fees. Motion passed unanimously, The fees need to be paid in April or
May of 2005. Vicky will bill for the assessment in the next water billing which will give members time to pay in
small installments if needed.

There was a discussion of accountability of water intake and outgo. Debbie noted that at this time there does not
seem to be an imbalance or water shortage. We now measure the outgo from the tank vs. the usage through each
member meter to check for a balance of water usage. There was a discussion of our ability to measure incoming
water from the well into the tank. This will be investigated.

Election of Officers
Maintenance: Chris Knapp volunteered to be the meter reader and was elected maintenance officer.
Treasurer: Victoria (Vicky) Moore was elected Treasurer.
Secretary: Pat Boer was elected Secretary.
Vice President: Jeff Hall was elected Vice President
President: Debbie St. Pierre was elected President.

All officers were elected unanimously and thanked for their willingness to serve.

Jack thanked all members especially the new members, for attending and participating.

Jack Dickey, outgoing president, is thanked by the members for the time and effort he has given as president of the
association.
Bill Moore is also thanked for the many hours he has given providing maintenance.

NOTE: At the meeting, we will see if ALL MEMBERS have received their subpoena?s for the small claims court. The Judge said ALL MEMBERS must be served. I asked  our attorney and was told that every member that is in the Association must be served.

So far, Mr. Hall and myself are the only two that have been served, there is still 16
members left to be served.

My brief will be available to members at the meeting.

Minutes
January 14, 2012
 

The meeting was called to order by President Debbie St. Pierre. Meeting was located on the property of
Dan Spears. All those present were Dan Spears, Debbie St. Pierre, Bob Franko, Leroy and Janice Smith,
Sherry, Gary Boer, Eric Schaumberger, Tina Ziegler and Jeff Hall.

The Minutes from last meeting were dispersed and discussed. Debbie moved and Jeff seconded the
minutes as read. Unanimously voted.

Officers were voted in as follows:

President is Jeff Hall-nominated by Leroy seconded by Bob
Vice President is Bob Franko-nominated by Jeff seconded by Eric
Secretary/Treasurer is Debbie St. Pierre-nominated by Jeff seconded by Gary
? Maintenance is Dan Spears-nominated by Leroy seconded by Eric (Leroy, Jeff and Eric to help
when needed)

Discussions:

Dan wanted to thank Leroy and Eric for all their help with the water tanks. And thank you to Gary who
donated all the supplies for the fix.

Put in by-laws that if property gets sold with an amount owed on water it becomes the responsibility of
the new owner to pay. Also procedure is to send a welcome letter to all new owners with a copy of the
by-laws.

Dan wanted to put no growing of pot plants in the by-laws but was voted against unanimously
.Reasonably cannot specify every item in the by-laws or we would have 500 pages. Each event that
comes up will be discussed and voted on by the association at that time.

Debbie- there is $1300.00 in the maintenance fund should we raise rates? Voted and denied.

Blackwelder property is not hooked into water system, should we charge a $2000.00 hookup fee? Voted
and denied. Agreed to just hook them up.

Tina audited the association book s and found no discrepancies. She also found that Debbie does not
pay herself for office items such as paper, folders, envelopes etc. It was discussed and voted that she
needs to reimburse herself for such items and attach receipts to monthly report.

It has been stated that company checks needing 2 signatures cannot be signed by two members of the
same family or household.

Gary-where water tanks are located on Murphy rd. are they sitting on his property. Please check
easement and let him know.
 

Beverly Heath's water shut off was discussed and Dan Spears has now been served to court. All have
agreed that a letter (see attached) with all terms and money owed with an open payment plan as to
what Beverly can afford without being a financial burden. We have given her enough time to think it
over and we are requesting that she drop the lawsuit. This problem has been going on to long and needs
to be solved. Note that Dan Spears did not agree with the reconnection fee of $2000.00 dollars.

Last item on the agenda was that from this point forward any Weber Valley Water questions or
problems are to be sent to the current President.

Gary moved and all agreed and meeting was adjourned at 2:10pm.
